Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using the Service, you confirm that you are at least 18 years old, have the legal authority to enter into these Terms, and agree to comply with all applicable laws and regulations. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

Sellinger AI is an agentic sales platform that provides autonomous AI agents for multi-channel sales outreach, including LinkedIn, Email, WhatsApp, Voice, and Live Chat. The Service also includes intent signal detection, lead enrichment, and related analytics tools. Features may be added, modified, or discontinued at our discretion.

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security and confidentiality of your login credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that contain false or misleading information.

4. Subscription and Billing

• Modular pricing: The Service is offered on a modular subscription basis. You pay only for the channels and features you activate.
• Free trial: We may offer a free trial period. At the end of the trial, you will be required to subscribe to a paid plan to continue accessing premium features.
• Billing cycle: Subscriptions are billed monthly or annually, as selected at checkout. Fees are non-refundable except as required by law or as stated in our refund policy.
• Price changes: We may adjust pricing with at least 30 days' prior notice. Continued use after the effective date constitutes acceptance.
• Cancellation: You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period.

5. Acceptable Use

You agree not to use the Service to:

• Send unsolicited bulk messages (spam) or engage in deceptive practices
• Violate any applicable law, regulation, or third-party rights
• Harass, threaten, or harm any individual or organization
• Distribute malware, viruses, or other harmful software
• Attempt to gain unauthorized access to the Service or its infrastructure
• Scrape or harvest data from the Service for unauthorized purposes
• Impersonate another person or entity
• Violate the terms of service of any third-party platform used through the Service

We reserve the right to suspend or terminate your account for violation of these guidelines, with or without prior notice.

6. LinkedIn Usage Guidelines

Sellinger provides tools for LinkedIn outreach and engagement. By using these features, you acknowledge and agree that:

• You are solely responsible for ensuring your LinkedIn activity complies with LinkedIn's User Agreement and Professional Community Policies.
• Sellinger is not affiliated with, endorsed by, or sponsored by LinkedIn Corporation.
• You will use outreach volume settings responsibly and within safe daily limits to protect your LinkedIn account.
• Sellinger is not liable for any restrictions, suspensions, or actions taken by LinkedIn against your account as a result of your activity.
• You will not use the Service to send misleading, inappropriate, or offensive messages on LinkedIn.

7. Intellectual Property

All content, features, functionality, trademarks, and proprietary technology of the Service are owned by Sellinger AI and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

You retain ownership of any content you upload to the Service (e.g., lead lists, message templates). By uploading content, you grant us a limited license to use it solely to provide and improve the Service.

8. Data Processing

Our collection and use of personal data is governed by our Privacy Policy. By using the Service, you consent to such processing and warrant that all data you provide is accurate. Where applicable, we will enter into a Data Processing Agreement (DPA) with enterprise customers upon request.

9. Limitation of Liability

To the maximum extent permitted by law, Sellinger AI and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from or related to your use of the Service.

Our total aggregate liability for all claims arising under these Terms shall not exceed the amount you paid to Sellinger in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Sellinger AI and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use of the Service, violation of these Terms, or infringement of any third-party rights.

11. Termination

Either party may terminate these Terms at any time. You may terminate by deleting your account or contacting us. We may terminate or suspend your access immediately, without prior notice, if you breach these Terms or for any other reason at our sole discretion.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) will remain in effect.

12. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good faith negotiation. If the dispute cannot be resolved within 30 days, either party may submit the dispute to binding arbitration in accordance with the rules of the applicable arbitration body in the jurisdiction set forth below.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Bulgaria, without regard to its conflict of law provisions. You consent to the exclusive jurisdiction of the courts located in Sofia, Bulgaria for the resolution of any disputes.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the "Last updated" date at the top of this page and, where appropriate, by sending you an email notification. Your continued use of the Service following the posting of revised Terms constitutes your acceptance of the changes.
